Fraudulent Multi Level Marketing [MLM] Company Destiny 2000 Limited has started construction of a five-star hotel at Cox's Bazar sea beach area [within the Sea-in Point] without obtaining any approval of the architectural design of environment certificate. In addition to this, the MLM Company is constructing another 9-storied building adjacent to this illegal hotel project. According to information, Destiny 2000 Limited has placed a huge signboard of its "Best Western Destiny Beach Hotel & Resorts", claiming it to be the first-ever five star chain-beach hotels in Cox's Bazar area. In this signboard, Destiny 2000 Limited has also provided description of facilities in this project, which include Super Deluxe Suite, Deluxe Suite, Presidential Suite, Honeymoon Suite, Spa, Bar, Restaurant, Banquet Hall, Business and fitness center, Bar-B-Q and rooftop restaurant. On investigation it was revealed that the MLM Company has not applied with the relevant authorities for permission of starting bar inside the project. Former chief of Bangladesh Army, Lt. Gen [Retired] Harron Ar Rashid is the coordinator of this illegal project, who is exerting his influence in letting the company continue its illegal construction on the very sensitive Sea-in-point of the largest sea beach in Bangladesh. Commenting on the illegal construction of the Best Western Destiny Beach Hotel & Resorts as well as the nine-storied building of Destiny 2000 Limited, Abdullah Al Mamun, assistant director of the Directorate of Environment told reporters that they have already served a notice on April 17 asking the authorities of Destiny 2000 Limited authorities to show cause as to why such constructions are continuing without any lawful authorities. The last date of responding to this show-cause notice is April 30, after which the Directorate of Environment will take necessary legal actions against the project.
It may be mentioned here that, during the tenure of BNP-Jamaat coalition government, leaders of Bangladesh Nationalist Party [BNP] took lease of 100 plots at Cox's Bazar sea beach area with the excuse of constructing hotels and motels. Since then, the area is known 'BNP Palli' [BNP Village]. When Bangladesh Awami League came in power in 2009, it cancelled lease order of 49 plots for irregular and illegal leasing out of the plots to the BNP leaders. Destiny 2000 Limited, which was having intimate relations with several heavy-weight leaders of Bangladesh Nationalist Party as well as Hawa Bhaban, managed to get few plots from those 100 plots from a number of BNP leaders. It may be mentioned here that, mastermind of Destiny 2000 Limited, Mohammad Rafiqul Amin was maintaining intimate relations with the top-brasses in BNP-Jamaat government as well as few big-fishes of infamous Hawa Bhaban.
It may be mentioned here that the Bangladesh Supreme Court's High Court division passed an order banning all forms of legal and illegal constructions within the sea beach area. In this case, Destiny 2000 Limited is clearly violating the order of Bangladesh Supreme Court, which may is a clear contempt of court. District authorities of Cox's Bazar told reporters that the Cox's Bazar Municipality accorded permission to Destiny 2000 Limited for the construction of the nine-storied building, while there was no permission issued for the construction of Best Western Destiny Beach Hotel & Resorts. On the other hand, Raj Bihari Das, the acting mayor of Cox's Bazar municipal corporation rejected the claim of the district authorities and said the municipality did not issue any approval order in favor of Destiny 2000 Limited for the construction of the 9-storied building. He added saying the former mayor of Cox's Bazar municipality, Sarwar Kamal was removed for issuing permission to a number of building in violating of the existing rules. According to the existing laws, even after obtaining permission from the municipal corporation, the intending constructors of any buildings within the sea-beach areas are mandatorily required to obtain clearance certificate from the Directorate of Environment.
Commenting on High Court's order banning all forms of construction within the sea-beach areas, authorities of Cox's Bazar district administration said, the High Court has already demarcated the areas within the sea-beach, where constructions are forbidden. If Destiny's constructions are continuing within that demarcated zones, immediate actions will be taken to stop such illegal constructions.
Deputy Commissioner of Cox's Bazar district, Mohammad Joynul Bari told reporters that the district administration did not give any permission to Destiny 2000 Limited for construction of Best Western Destiny Beach Hotel & Resorts. On the other hand, the authorities of Destiny 2000 Limited and Best Western Destiny Beach Hotel & Resorts told reporters that the permission for the 9-storied building and Best Western Destiny Beach Hotel & Resorts were given by the municipal authorities. He said, Destiny 2000 Limited and Best Western Destiny Beach Hotel & Resorts applied for environment certificate from the Directorate of Environment in 2011. As the directorate is delaying the process of issuing clearance, it [Destiny 2000 Limited] is continuing the construction. It may be mentioned here that, construction of any structures within sea beach area without clearance certificate issued by the Directorate of Environment is illegal.
